User Agreement

This User Agreement (hereinafter the “Agreement”) is a legally binding contract between you and Pairfuse (“Pairfuse,” “we,” “us,” or “our”). By accessing the Pairfuse service, website, or any related applications (collectively, the “Service”), you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms, you must not use the Service.

Please also review our Privacy Policy to understand how we collect and use your personal data. This Agreement incorporates the Privacy Policy by reference.

1. Description of the Service

Pairfuse is an online platform providing access to artificial intelligence-based software for image generation. The Service allows for the creation of paired photoshoots (joint composite images of two faces) and, at your option, images of a hypothetical future child based on images provided by you (hereinafter, the “Input Images”). Pairfuse processes the Input Images to generate composite images (hereinafter, the “Output Images”) that combine traits of the provided faces.

The Service is provided exclusively for personal entertainment and informational purposes. Output Images are speculative in nature, are created by AI with an element of randomness, and may not bear resemblance to real people or future events.

Pairfuse may offer a one-time free generation option, as well as Paid Packages (“Generation Packages”) that allow for multiple generations. The features, prices, and limitations of each package are described on our Pricing page. Any use of the Service—free or paid—is governed by this Agreement.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet the age requirement and have the legal capacity to enter into this Agreement.

The Service is intended for personal, non-commercial use. You may not use the Service on behalf of a company or for commercial purposes (for example, offering the results of the Service to third parties for a fee) without our prior written permission.

3. User Content and Ownership Rights

3.1. Additional License for Free Generation Users

If you use the free generation option, you understand and agree that you grant Pairfuse an additional license for promotional and advertising purposes. In particular, by using the free Service, you grant Pairfuse an irrevocable, perpetual, non-exclusive, worldwide, fully paid, royalty-free license (with the right to sublicense and transfer) to use, publish, distribute, publicly display, and create derivative works from your User Content—including both the original Input Images and the resulting Output Images, as well as any image or persona depicted therein—in any and all media formats and channels, now known or hereafter developed, for any purposes (including commercial advertising and marketing), without any compensation to you. You agree that Pairfuse may post or publish your Input Images and Output Images on our website, in our social media accounts (e.g., Telegram, Instagram, TikTok, and other social networks), or in other promotional materials.

You also acknowledge that such use of your content within the free Service is a condition of providing the free generation. To the maximum extent permitted by law, you waive any rights of privacy or rights of publicity regarding the User Content used by us under this license.

3.2. Privacy for Paid Use

If you purchase a Paid Package, Pairfuse will treat your User Content as private and confidential. We will not disclose, publish, or make available to third parties your Input Images or Output Images created under paid use, except: (i) as necessary for the operation of the Service (e.g., to our cloud storage providers or processing partners under strict confidentiality), (ii) where required by law or legal process, or (iii) with your explicit consent.

Pairfuse does not use paid-plan User Content for marketing or advertising purposes without your permission. However, if you as a paid user choose to share results publicly or ask us to publish them, you grant us permission to use such content in a manner similar to that described for free users.

3.3. Representations and Warranties Regarding User Content

You are solely responsible for all User Content that you upload or provide. You represent and warrant that:

• Strict age requirements for Input Images: You represent and warrant that all persons depicted in the Input Images you upload have reached the age of 18. Uploading photos of minors (children under 18 years old) is strictly prohibited. You agree not to use the Service to generate content depicting minors in any sexualized, harmful, or inappropriate context.
• Consent of depicted persons: If any Input Images or other User Content depict a person other than yourself, you have obtained that person’s informed consent to upload and process their image in the Service.
• No infringement of rights or law: Your User Content does not infringe any intellectual property rights, privacy rights, rights of publicity, or other legal rights of third parties.
• No impermissible content: Your Input Images and other uploaded content must not contain nudity, explicit sexual material, graphic violence, or content that is illegal, hateful, or otherwise impermissible.

If you breach any of the above representations or warranties, you agree to indemnify us and hold us harmless against claims (as set out in Section 10 below). We reserve the right to block your account and annul any remaining generations without refund for violation of these rules.

4. Free Generation Terms

Pairfuse may provide a one-time free image generation on a limited basis. This service is provided as a courtesy, is available subject to available resources, and is subject to certain conditions:

• Limited slots: Free generations are limited, and conditions may change. We may require compliance with certain criteria for participation (e.g., subscribing to official social media channels).
• One-time nature: Free generation is typically provided once per user. Creating multiple accounts to obtain additional free generations is prohibited.
• Publicity condition: As stated in Section 3.1, by using free generation, you agree that Pairfuse may publish and publicly use your photos and results.

5. Paid Packages and Payments

Pairfuse offers Generation Packages (digital goods) that provide you with a certain number of generation attempts (“generations”) for a one-time fee. By purchasing a package, you agree to the following:

• Merchant of Record: The checkout process is handled by our authorized Merchant of Record. They are responsible for order processing, payment support, and handling refunds.
• Cost and taxes: You must pay for the selected package upfront. Prices and available packages are listed on the Pricing page. Prices displayed on the site may not include applicable taxes (such as VAT, GST, or sales tax) depending on your location. The final price including taxes will be calculated and shown at checkout by our Merchant of Record.
• Validity of generations (Credits): Purchased generations are valid for 12 months from the date of purchase. If you do not use your generations within this period, they will expire and be removed from your account balance without compensation.
• Non-refundable after use: Generation Packages are digital goods. Once you have started using a package (i.e., performed at least one generation), the sale is considered final and non-refundable, except as provided by applicable consumer protection law. Please review our Refund Policy for details.
• Technical failures: In the event of a technical error on our side (e.g., server timeout) during a generation attempt, the deducted generation credit will be automatically returned to your account balance. Monetary refunds for individual failed generations are not provided.

6. Acceptable Use and User Conduct

We expect users to use Pairfuse lawfully and respectfully. You agree not to do the following:

• Infringe rights: Upload or provide content that infringes any intellectual property rights or other rights.
• Engage in illegal or harmful acts: Use the Service for any illegal activity or to generate/distribute illegal, violent, hateful, pornographic, harassing, or defamatory content.
• Interfere with the Service: Attempt to disrupt the normal operation of Pairfuse (e.g., hacking, DDOS attacks, introducing viruses).
• Circumvent limits: Use unauthorized means to bypass limits or payments.
• Reverse engineering: Attempt to reverse engineer, decode, or extract the source code or models of the Service.

Pairfuse reserves the right to investigate and take necessary measures (including blocking accounts) against users who violate these rules.

Use of results: We grant you a personal, non-commercial, non-exclusive, non-transferable license to download and use the Output Images created for you for lawful purposes. You agree not to use the Output Images in ways that violate the law or anyone’s rights (e.g., for fraud or claiming it represents a real person).

7. Pairfuse Intellectual Property Rights

Pairfuse Content: Aside from your User Content, all materials and content of the Service—including software, algorithms, design, texts, graphics, logos, and any information generated by the Service (excluding specific Output Images generated for you) (collectively, “Pairfuse Content”)—belong to Pairfuse or its licensors and are protected by laws.

Your license to use the Service: Subject to your compliance with this Agreement and payment of applicable fees, Pairfuse grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service and Pairfuse Content for personal non-commercial purposes, solely within the scope of the normal functions of the Service.

You may not use, copy, modify, distribute, sell, or lease any parts of our Service or Pairfuse Content, nor attempt to reverse engineer or extract source code, except as permitted by law or with our written permission.

8. Disclaimer of Warranties

Use at your own risk: You use the Service and any results obtained (Output Images and otherwise) at your own risk. The Service is provided “AS IS” and “AS AVAILABLE” without any express or implied warranties.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAIRFUSE AND ITS AFFILIATES, LICENSORS, AND SUPPLIERS MAKE NO WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, REGARDING THE SERVICE OR THE RESULTS OBTAINED THROUGH IT. WE DO NOT WARRANT THAT THE OUTPUT IMAGES WILL BE AN ACCURATE OR REALISTIC PREDICTION OF FUTURE EVENTS, OR THAT THE SERVICE WILL OPERATE WITHOUT INTERRUPTION OR ERRORS.

AI-generated content: You understand and agree that images created by Pairfuse are generated by an artificial intelligence algorithm based on data provided by you. Output Images are speculative in nature and intended only for entertainment. Pairfuse does not represent or warrant that any generated image will resemble a real child that may be born to the depicted persons. Dissatisfaction with the aesthetic qualities of Output Images is not grounds for a refund.

No guarantee of availability: Pairfuse does not guarantee continuous availability of the Service. We do not guarantee that any content (including your User Content or Output Images) will be stored or available for download at any given moment.

9. Limitation of Liability

Limited remedies: TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PAIRFUSE OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AFFILIATES, OR LICENSORS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, AS WELL AS FOR LOSS OF PROFITS, REVENUE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING IN CONNECTION WITH ACCESS TO OR USE OF THE SERVICE (OR INABILITY TO USE IT), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Liability cap: TO THE EXTENT THAT EXCLUSION OF LIABILITY IS NOT POSSIBLE, AND TO THE LIMITS PERMITTED BY LAW, THE AGGREGATE LIABILITY OF PAIRFUSE AND ITS AFFILIATES FOR ANY CLAIMS ARISING FROM THIS AGREEMENT OR RELATED USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO PAIRFUSE FOR THE SERVICE DURING THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH LIABILITY, OR USD 100 (OR EQUIVALENT), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Pairfuse, its parent company, affiliates, and their officers, directors, employees, and agents (“Pairfuse Parties”) from and against any and all losses, liabilities, claims, suits, damages, expenses, and costs (“Claims”), including reasonable attorneys’ fees, arising from or related to: (a) your use or misuse of the Service or Output Images; (b) your User Content (including any infringement of third-party rights); (c) your breach of this Agreement or applicable law; or (d) your violation of the rights of others.

Pairfuse reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such matters. You agree not to settle any matter without the prior written consent of Pairfuse.

11. Termination

You may terminate this Agreement at any time by ceasing to use the Service and deleting your account. If you delete your account voluntarily, any remaining generation balance is immediately annulled and is not refundable.

We may terminate or suspend your access immediately if you breach this Agreement (e.g., upload prohibited content). In such cases, you forfeit the right to any remaining balance.

Discontinuation of Service: If Pairfuse decides to completely discontinue the Service, we will provide notice at least 30 days in advance via the website or email. You must use all remaining generations within this notice period. Upon expiration of this period, the Service will be stopped, and any unused generations will be annulled without compensation.

12. Governing Law and Dispute Resolution

Governing law: This Agreement is governed by the laws of the Republic of Poland without regard to conflict of laws principles, provided that if you are a consumer in a jurisdiction providing mandatory consumer protection rights, nothing in this Agreement deprives you of such rights.

Jurisdiction: Subject to the arbitration clause below (for US users), all disputes are subject to the exclusive jurisdiction of the competent courts of Poland. However, you and we agree that we may bring suits in your country of residence to protect our rights or enforce your obligations. If you are a consumer residing in the EU, you may also bring a claim in your local court.

US Users — Arbitration and Class Action Waiver: If you are a resident of the United States, you and Pairfuse agree that any disputes, claims, or controversies arising out of this Agreement or use of the Service shall be resolved by final and binding arbitration, rather than in court. You acknowledge and agree to waive the right to a jury trial and the right to participate in a class action or class arbitration.

This arbitration agreement is governed by the US Federal Arbitration Act (FAA). Arbitration is administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator has the authority to determine the rights and obligations of the parties.

Class Action Waiver: You and Pairfuse agree that all claims and disputes must be arbitrated on an individual basis and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

Opt-out: You have the right to opt out of binding arbitration and the class action waiver within 30 days of first accepting this Agreement by sending us a written notice at contact@pairfuse.com.

14. Changes to this Agreement

Pairfuse may from time to time modify or update this User Agreement. We will notify users of material changes by posting the updated version on the website. Changes take effect no earlier than fourteen (14) days after posting. Continued use after the effective date of changes constitutes your acceptance of the modified terms.

15. Miscellaneous

Entire agreement: This Agreement (together with the Privacy Policy) constitutes the entire agreement between you and Pairfuse regarding use of the Service.

Waiver and severability: Our failure to timely exercise any right or provision shall not be considered a waiver of such right or provision. If any provision is held by a court or arbitrator to be invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force.

Assignment: You may not assign or transfer this Agreement without our prior written consent. Pairfuse may freely assign or transfer this Agreement.

Electronic communications: You agree to receive electronic communications from us (e-mail, in-Service notices) and to retain copies of them.

Language: The English version of this Agreement is the primary version and shall prevail in case of discrepancies.
